Frequently Asked Questions / Terms & Conditions


  1. Booking
    Registration for a course(s) occurs once you have received written confirmation from ELS of Cape Town.
     
  2. Class Times
    All courses, except private lessons and Tour Group programs, begin every Monday (except when Monday is a public holiday, in which case the course will start on a Tuesday). ELS of Cape Town reserves the right to introduce a double timetable where students alternate between morning and afternoon lessons, on a weekly or daily basis.
     
  3. Lessons
    ELS of Cape Town’s lessons are of 55 minutes duration. There is a maximum of 10 students per class aiding in providing optimum learning conditions. iStudy sessions consist of independent study using resource material provided by the school, these sessions are free of charge and are not compulsory.
     
  4. Course Material
    A course book deposit is payable on the first day, however the book remains the property of ELS of Cape Town. Should the book be damaged or not returned the book deposit will be kept by ELS of Cape Town.
     
  5. Airport Transfers
    Transfer fees to and from the airport are included should ELS of Cape Town accommodation be used, and provided the student arrives up to 7 days before the course is due to starts and departs up to 7 days after the course has ended.  Flight details must be provided 7 days before arrival and departure in order for ELS of Cape Town to provide airport transfer, these details include arrival time, flight numbers, airline and point of origin. No refunds will be granted on transfers if flight details are not received by ELS of Cape Town on time.

    The maximum waiting period for our driver is 1 hour, thereafter alternative transport will be arranged. The maximum waiting period for the student is 1 hour, thereafter the student will be charged a fee of $50 at the school. If the student does not see the driver with the ELS of Cape Town logo, they are to call our emergency number which is provided in the booking information.
     
  6. Payments
    Payments may be effected by bank transfer or credit card and must be received in full, 14 days prior to the course start date. If fees are not paid 14 days prior to commencement, ELS of Cape Town reserves the right to decline the course placement.  Bank details are provided on our invoice and bank fees are for the students account.
     
  7. Changes to enrolment
    ELS of Cape Town reserves the right to charge an Administration Fee of $50 each time the course or accommodation is changed after confirmation has been received from ELS of Cape Town.
     
  8. Administration and Registration Fee
    An administration fee of $75 and a registration fee of $75 are already included in the course fees and are non-refundable.
     
  9. Cancellations and Refunds

    Notice of cancellation must be made in writing to ELS of Cape Town.

    If we receive a written cancellation 28 days or more before your course is scheduled to begin, we will refund 100% of your fees, minus any non-refundable items, cancellation fee of $150 and bank and transfer costs. If we receive your written cancellation 8-27 days before your course is scheduled to start, we will refund 50% of your fees, minus any non-refundable items, cancellation fee of $150 and bank and transfer costs. Fees will not be refunded if cancellations, written or otherwise, are received 7 days or fewer before your course is scheduled to begin.

    If a visa application is rejected, and ELS of Cape Town receives a certified copy at least 7 days prior to arrival, ELS will refund the fees received in full; minus any non-refundable items, cancellation fee of $150 and bank and transfer costs. A further cancellation fee equivalent to 1 week’s accommodation and tuition will apply if we receive a certified copy less than 7 days prior to arrival.
     
  10. Homestay arrangements
    You may seek to vary your homestay arrangements provided you do so through us. We, at our sole discretion, may vary your homestay arrangements if we see fit to do so. Any change to the homestay arrangement will incur a fee equivalent to four weeks stay and an administration cost of $50.

    Host Families are carefully selected by ELS of Cape Town. They range from married couples to single person establishments, with or without children or pets. Other students can be accommodated in the same family, subject to availability. Accommodation is usually allocated until 11am on the date of departure. In addition to our rules and regulations, you will comply with the rules set down by your homestay family.
     
  11. Visa
    Payment must be received in full, prior to any visa documents being issued. There is a charge of $90 each time documents have to be sent by courier. Whilst ELS of Cape Town endeavours to support you at all times, ELS of Cape Town cannot be held responsible for decisions taken by Embassies or Immigration Police regarding entry visas or visa extensions. Should the arrival day be postponed due to delayed visa applications, ELS of Cape Town cannot guarantee the original accommodation allocation.

    Students enrolling for 24 weeks or more are entitled to a break from studies of no more than 4 weeks, students are to ensure that their visa is issued for the correct dates to include any holiday breaks.
     
  12. Student Holiday Leave
    -Students must give a 2 week notice period prior before student holiday leave can be taken.
    -Holiday leave must start on a Monday and end on a Friday.
    -Students returning from holiday cannot expect to return to the same class, teacher or accommodation. No credit is given for accommodation during holiday breaks.
     
  13. Insurance
    ELS of Cape Town does not insure students against illness, accident, theft, or against any loss of personal effects whatsoever, at any time. Neither ELS of Cape Town nor its representatives will accept responsibility for any accident that may occur to any student for the duration of a course of study, either during excursions or during any other activities, whether on or off the premises of the institution. ELS of Cape Town therefore recommends that students take out full personal insurance cover, including medical and any other foreseeable expenses.
     
  14. Age
    ELS of Cape Town is open to all ages, however we do not provide supervision for students younger than 18 who book an adult course with us.
     
  15. Level of English
    If you do not have the minimum level of English required to follow a specific course, as determined by ELS of Cape Town Placement Test, ELS of Cape Town reserves the right to move you to an appropriate course for your level. This may result in a reduction of hours.
     
  16. Language Excursions
    Language Excursions takes place on a weekly basis and consist of student of different levels. Entrance fees and and/or refreshments are excluded. ELS of Cape Town provides one teacher on each excursion.
     
  17. Public holidays
    ELS of Cape Town will be closed on all official public holidays in South Africa. No reduction in price will be considered, except where this is specifically stated. Please contact us to find out the public holidays for the current year.
     
  18. Student performance commitment
    • The student agrees to only speak English while on ELS of Cape Town premises.
    • It is the student’s responsibility to arrive for lessons on time. If you miss lessons or are late for lessons, you will not be refunded or be able to make them up at a later date. Students must notify ELS of Cape Town if they will not be attending school.
    • Student’s who fail to attend 80% will not receive a certificate.
    • Private tuition must be cancelled 24 hours in advance.
    • Students may not approach teachers at ELS of Cape Town for private tuition outside of ELS of Cape Town premises.
    • The students are required to show courtesy to our teachers and each other. The teacher facilitates, directs and mediates all language learning activities.
    • ELS of Cape Town reserves the right to take still and video footage of students to be used for promotional purposes. If students do not wish to be imaged in anyway, they are to inform ELS of Cape Town who will respect their wishes.
       
  19. Misconduct/disciplinary procedures
    ELS of Cape Town reserves the right to expel a student for unacceptable behaviour or lack of attendance. No refund will be given. Repatriation is at student’s own expense.
    Students must pay the full cost of any damage they cause to property.
     
  20. Place of jurisdiction
    This contract sets out the full basis of the relationship between ELS of Cape Town and the student who, by entering into agreement with us, acknowledges that it is governed by the laws of The Republic of South Africa and only the courts of The Republic of South Africa shall have jurisdiction.
     
  21. Force Majeure
    ELS of Cape Town will not be responsible for any failure to comply with any of its obligations (and, therefore, shall not be required to provide any compensation) if the failure is occasioned by any cause beyond ELS reasonable control; nor shall ELS of Cape Town be responsible for any costs incurred by or on behalf of the student as a result of any such cause. Such causes shall include, but shall not be limited to, war, threat of war, riot, civil strife, industrial dispute, terrorist activity, natural or nuclear disaster and unusually adverse weather conditions.
     
  22. Privacy
    - We will hold personal information about you so that we may carry out our responsibilities under this agreement and otherwise. The information you supply to us must be true and correct
    - You will have the right to correct personal information held about you. You and we agree that information held by us as to your academic progress is evaluative material and not personal information.
    - We may check or disclose the personal information we hold about you with or to such persons as credit agencies, homestay providers, local schools, activity providers and the Cape Town Immigration Service and you consent to and authorise the same.
     
  23. Warranty/consents
    - You warrant that as a party to this agreement you are a person aged over 18 years and/or have legal capacity to execute this agreement in respect of the student.
    - If you are not the student then you warrant that you have explained to the student all their obligations under this agreement.

    In the event that you or the student suffer a personal injury or illness at any time during your or their course in Cape Town, you consent to the arrangement of such medical intervention as is necessary to preserve life and/or wellbeing by us, our agents and/or third party service providers and you release us from any liability in respect of such action, and will indemnify and hold us harmless for all cost or liability we incur in respect of such action.
     
  24. Termination
    If you fail to meet your obligations under this agreement, we will send a written notice to you at your last known address in Cape Town explaining to you what is wrong, what needs to be done and when it must be done by. If you do not comply with that notice we may terminate this agreement immediately.
     
  25. Notice of Address
    You will keep us at all times informed of your current address and phone number in Cape Town while undertaking one of our courses. You agree that this is an important term of the agreement between us, the breach of which shall entitle us summarily to terminate this agreement and to expel you from the school.
     
  26. Liability
    Exclusion and Limit of Liability - We will not be liable to you for any property that has been physically damaged or lost, for any other direct loss or damage or for any indirect or consequential loss whatsoever whether caused through breach of contract or breach of any other obligation owed to you for any other reason.

    You will indemnify and hold us harmless in respect of all express, losses, damages and costs (on a full indemnity basis) incurred by or awarded against us arising out of any claim by any person in relation to your conduct in Cape Town.
     
  27. Change to prices, dates or programs
    Provided that no confirmation of registration has been issued, ELS shall have the right, at any time, to change the dates and prices published in the course schedule, either on the Internet or elsewhere.
     
  28. Change of terms and conditions
    These terms and conditions are subject to change, at any time, by ELS of Cape Town.
